IMPORTANT: Applicant is requested to read these Terms & Conditions before completing the Application Form CONDITIONS OF USE OF AL MUSAFIR CARD These terms and conditions shall apply to the usage of Al Musafir Card by the Cardholder. If there is anything you do not understand or agree with, please contact our Customer Services using contact details provided herein. In these terms and conditions “You” means Al Musafir Cardholder, being the authorised user of the Card. “We”, “Us” or “Our” means Al Rajhi Banking & Investment Corporation (Malaysia) Bhd (Co.No. 719057-X) having its registered address at Ground Floor, East Block, Wisma Selangor Dredging, 142-B, Jalan Ampang, 50450 Kuala Lumpur.

1.   DEFINITION

Account
means the electronic account associated with the Card;

Available Balance
means the cash balance available on the Card for cash withdrawal at ATM;

ATM
means an automated teller machine facilities or cash dispenser facilities provided by Al Rajhi Bank, Kingdom of Saudi Arabia;

Al Musafir Card or Card
means an e-money pre-paid card issued to the Cardholder in accordance with these terms and conditions;

Card Number
means the 18 digit number in front of the Card;

Cardholder
means You the authorised user of the Card;

SAR or Saudi Riyal
means the lawful currency for the time being of Kingdom of Saudi Arabia;

PIN
means the personal identification number for use with the Card;

2.   SCOPE OF THIS TERMS & CONDITIONS

2.1 The applicable Shariah principle shall be the principle of Qard. The cash paid by the Cardholders for the value of the Card shall be pooled and deposited into a Current Account maintained with Al Rajhi Bank, Kingdom of Saudi Arabia to facilitate the withdrawal transactions by the Cardholders in the Kingdom of Saudi Arabia.

2.2 The Card is a pre-paid, stored value card that once activated, can be used at the ATM of Al Rajhi Bank in the Kingdom of Saudi Arabia for cash withdrawal in SAR denomination. Before using the Card, you need to ensure that there is sufficient Available Balance. The Card is not a credit card or a charge card or a debit card and is not in any way connected to your bank account. You will not earn any profits on the Available Balance on the Card.

2.3 Al Musafir Card has been issued by us in accordance with our specifications and requirements. Your rights and obligations relating to the use of the Card are subject to these terms and conditions. The Card remains the property of Al Rajhi Banking & Investment Corporation (Malaysia) Bhd (Co. No. 719057-X).

3.   BUYING AND ACTIVATING YOUR CARD

3.1 You may apply for the Card if you are 16 years old and above and each Cardholder is allowed to apply for the Card in total of up to the maximum value of equivalent to Ringgit Malaysia Twenty Thousand only (RM20,000-00) at any one time. The Card is issued in SAR denomination of 550 SAR or 1050 SAR or 3050 SAR. As the authorised user you are responsible for any fees or charges that the Card may incur.

3.2 The usage of the Card shall be subject to Anti Money Laundering and Anti-Terrorism Financing Act 2001, all relevant Exchange Control Regulations and guidelines issued by the Bank Negara Malaysia from time to time as may be applicable so far as it complies with the Shariah principles. The use of the Card in the Kingdom of Saudi Arabia shall be subject to all relevant regulations issued by the Saudi Arabian Monetary Authority (SAMA) so far as it complies with the Shariah principles.

3.3 You may procure the Card at any of our branches in Malaysia. We will issue the Card to you on the basis of the information that you have provided in the attached application form. You agree to provide accurate personal information and to inform us of any changes as soon as possible so that our records remain correct and updated. You should update any changes to your personal information by calling our Customer Service.

3.4 The applicable currency conversion rate shall be the prevailing rate of the day you procure the Card. The Card shall be activated and available for use the day after.

3.5 You will be given your PIN when you procure the Card. The PIN shall not be changed. You shall observe all security measures prescribed by us relating to the Card, PIN or the services provided thereunder. You shall not reveal your PIN to anyone including our staff. If there is suspicion the PIN has been disclosed to third parties, you shall inform us immediately for necessary action to be taken including but not limited to blocking the Card and issue a replacement card and new PIN to you.

3.6 We shall not be liable for any loss of or damage to the Card and any loss or damage arising from the wrong PIN being keyed in by you in the course of utilising the Card at any ATM facility save where such loss or damage are due to our gross negligence, misconduct and fraud.

4.   USAGE OF THE CARD

The Card will be used exclusively to effect cash withdrawals and balance inquiry at the ATM facilities in the Kingdom of Saudi Arabia. All cash withdrawal transactions are subject to transaction charges and fees. We will deduct the value of your transactions and any applicable fees and charges from the Available Balance as soon as the transactions are made. You are not allowed to effect cash withdrawals that exceed the Available Balance.

5.   CANCELLATION AND EXPIRY OF CARD

5.1 If your Card is cancelled after it has been procured, we will refund the Available Balance to you. The applicable currency conversion rate shall be the rate of the day the Available Balance of the Card is refunded. You will not be entitled to a refund of money you have already withdrawn or any fees or charges incurred before the Card is cancelled or expires. For avoidance of doubt, the Available Balance shall be, upon cancellation thereof by the
Cardholder remain intact until refund process is completed.

5.2 The issuance fee of the Card is non-refundable. You may cancel your Card and obtain the refund of the Available Balance at any branch of Al Rajhi Bank, Malaysia.

5.3 We may also cancel your Card immediately if we suspect fraud or misuse of the Card or if we have any other security or anti-money laundering concerns or if we are required to comply with the law. In the event we cancel your Card due to reasons hereof, we will notify you within five (5) Business Days after the cancellation date and you are required to obtain your refund of the Available Balance at any of our branches within twelve (12) months. We will classify the refund under the Unclaimed Monies Act 1965 after twelve (12) months.

5.3 Your Card will be valid for 36 months from the date of issuance or until the Available Balance has been fully utilized or refunded whichever is the earlier. When the Card expires, you will no longer be able to use the Card. Any Available Balance on the expired Card remains the property of the Cardholder. The Cardholder may claim for the refund of the Available Balance within twelve (12) months from the expiry date. We will classify the refund under the Unclaimed Monies Act 1965 after twelve (12) months.

6.   LOST, STOLEN OR DAMAGED CARD

6.1 You should treat your Card like cash in a wallet. If it is lost or stolen, you may lose some or all of your money on your Card, in the same way as if you lost cash. As a result, you must keep your Card safe and not allow other persons use it.

6.2 In the event of loss, theft, fraud or other risk of an unauthorized use or your Card is damaged or malfunctions, you must inform us immediately by calling our Customer Service. You will be asked to provide us with your Card Number and some identifying details. You will be liable for any unauthorised transactions that take place prior to you notifying us and these will reduce your Available Balance. If there is an Available Balance remaining on your Card, we will replace your Card and transfer the last Available Balance
onto it. You will collect your replacement Card at selected branches of Al Rajhi Bank, Kingdom of Saudi Arabia or any branch of Al Rajhi Bank, Malaysia, as the case may be.

6.3 You shall bear the onus of showing the Card was not used by you at the time a disputed transaction was entered into or recorded. All ATM transactions shall be deemed to have been made by you after you procure the Card and you shall be liable for all charges and withdrawals whatsoever arising from all ATM transactions thereof. The Bank's records of any transaction effected by the use of the Card shall be conclusive and binding on you.

7.   LIMITATION OF LIABILITY

Our liability in connection with these terms and conditions shall be subject to the following exclusions and limitations:-

  1. we shall not be liable for any default resulting directly or indirectly from any cause beyond our control, including but not limited to, a lack of funds and/or failure of network services at ATMs, maximum withdrawal limits set by Al Rajhi Bank, Kingdom of Saudi Arabia and failure of data processing systems;
  2. where the Card is faulty due to our fault, our liability shall be limited to replacement of the Card or refund of the Available Balance;
  3. where sums are incorrectly deducted from your Available Balance due to our fault, our liability shall be limited to payment to you of an equivalent amount;
  4. in all other circumstances of our default, our liability will be limited to refund of the Available Balance;

  5. Nothing in this Agreement shall exclude or limit our liability for loss resulting from our negligence, misconduct or fraud.

8.   FEES AND CHARGES

You agree to pay us the following fees in relation to the Card:-

(a) Card issuance fee of Ringgit Malaysia Fifteen only (RM 15.00);

(b) Card replacement fee, if the Card is replaced in Malaysia, of Ringgit Malaysia Fifteen only (RM 15.00);

(c) Card replacement fee, if the Card is replaced in Saudi Arabia, of Saudi Riyal Fifteen only (SAR 15.00);

(d) Cash withdrawal fee from an ATM Facility of Saudi Riyal Four only (SAR 4.00) for each withdrawal; and

The aforesaid fees and charges may be varied provided that such variation shall be effected only with the consent of the Cardholder, and generally subject to the variation provision in clause 14.5.

9.   REFUND

9.1 You may cancel the Card and obtain a refund for the Available Balance at any branch of Al Rajhi Bank Malaysia. The applicable currency conversion rate will be the rate on the day of the cancellation and refund are requested by you.

9.2 If the Card has been lost and you opt for cash refund of the Available Balance instead of a card replacement, the amount of Available Balance refunded to you will be in equivalent to SAR in Ringgit Malaysia at the applicable currency conversion rate at the time of the refund. Cash refund service shall be limited to over-the-counter transaction in Al Rajhi Bank, Malaysia only. Please note that cash refund service is not available in Al Rajhi Bank, Kingdom of Saudi Arabia.

10. DISPUTES

10.1 If you have a reason to believe that a transaction has been posted to your Account in error, you may ask us to investigate the transaction by contacting Customer Services.

10.2 If the disputed transaction is investigated and found the amount deducted to be incorrect the value of the transaction will be refunded to your Account.

11. COMPLAINTS PROCEDURES

11.1 Complaints regarding any element of the service provided by us should be sent in writing to us or by contacting the Customer Services.

11.2 All complaints will be subject to our Complaints Procedure. We will provide you with a copy of our Complaints Procedure upon request.

12. COMPENSATION

The Card is an electronic money product and although it is a product regulated by the Payment Systems Act 2003 and other relevant laws in Malaysia, it is not covered by any compensation scheme under the Malaysia Deposit Insurance Corporation Act 2005. No other compensation scheme exists to cover losses claimed in connection with the Card.

13. DISCLOSURE

You hereby consent for us to disclose any information pertaining to you to our parent company, branches, related corporations, associates, subsidiaries, affiliates, assignees, proposed assignees, agents and/or any other parties engaged by us to enable or assist us to exercise or enforce our right under these terms and conditions.

14. MISCELLANEOUS

14.1 Governing Law and Jurisdiction
These terms and conditions shall be governed by and shall be construed in all respects in accordance with the laws of Malaysia as far as it complies with Shariah Principles.

14.2 Time
Time shall be of the essence in these terms and conditions.

14.3 Waiver
No failure or delay on our part in exercising nor any omission to exercise any right, power, privilege or remedy accruing to us under these terms and conditions upon any default on your part shall impair any such right, power, privilege or remedy or be construed as a waiver thereof nor shall an acquiescence in any such default, affect or shall impair our right, power, privilege or remedy in respect of any other or subsequent default nor shall any single or partial exercise of any right or remedy prevent any further or other exercise thereof or the exercise of any other right or remedy. The rights and remedies herein provided are cumulative and not exclusive of any other rights or remedies provided by law.

14.4 Preservation of Rights and Entitlement
Not with standing any other provisions in these terms and conditions, our rights and entitlement hereof shall continue to remain in full force and effect and shall survive any cancellation or expiry of the Card.

14.5 Variation of terms
You hereby agree that we may vary, add to or amend the terms and conditions herein set out provided always that such variation addition or amendment may only be effected with your consent. Such variation, addition and amendment, if agreed upon, shall be operative on the effective date specified by us. In the event you do not agree to such variation, addition and amendment, you must cancel the Card within thirty (30) days of receipt of
the notice of such variation, addition and amendment, failing which you shall be deemed to have accepted such variation, addition and/or amendment without reservation.

14.7 Notices
Any correspondence notices, requests and demands to be given or made under these terms and conditions shall be in writing and shall be deemed to be sufficiently served:-

(a) if it is sent by the party by ordinary post to the other party at his address or at such other address as the other party might have notified the party giving the notice as his new address, three (3) days after the date of posting; or

(b) if it is dispatched by hand to the other party, on the day of delivery.

14.8 Severability
Any provisions of these terms and conditions which is invalid, unenforceable or prohibited shall not affect the validity or enforceability of the other provisions hereof.
